Terms and Conditions
Effective Date: May 11, 2025
These Terms and Conditions (“Terms”) govern your access to and use of any services, websites, content, or materials provided by Blue Collar Web Pro LLC d/b/a Morales Media Productions (“MMP,” “we,” “us,” or “our”).
By using our services or accessing our websites, you agree to these Terms. If you do not agree, do not use our services.
1. Services Provided
We offer creative services including (but not limited to) social media content, photography, videography, digital advertising, websites, and consulting. Details of the scope, pricing, and timeline for each project will be outlined in a separate agreement or invoice.
2. Client Responsibilities
Clients agree to:
Provide access, information, and approvals needed to complete work
Review and respond to drafts or deliverables in a timely manner
Make payments by the due date listed on the invoice
Delays in communication or payment may delay project delivery or result in late fees.
3. Payments & Refunds
All payments are due as invoiced unless otherwise agreed in writing. Monthly or recurring services are billed automatically unless canceled in advance. Refunds are not provided for completed work or missed appointments.
We reserve the right to pause or cancel services due to non-payment.
4. Intellectual Property
Upon full payment:
Clients receive a non-exclusive, perpetual license to use the final deliverables (e.g., edited videos, social graphics) for their marketing needs.
MMP retains copyright over all original creative assets.
Raw files, footage, or editable project files remain MMP property unless explicitly agreed upon in writing.
We may showcase completed work in our portfolio, on social media, or in promotional materials.
5. Content Guidelines
Clients are responsible for ensuring any materials they provide (logos, music, images, etc.) do not infringe on third-party rights. We reserve the right to reject or remove content that is unlawful, offensive, or violates platform rules.
6. Results & Performance
We strive to create high-quality content and campaigns. However, due to the nature of digital platforms, we cannot guarantee specific outcomes (e.g., views, sales, leads, or engagement).
Ad performance may vary based on targeting, budget, and platform changes.
7. Cancellation & Termination
Either party may cancel ongoing services with written notice (e.g., email). Any completed work will be invoiced, and any prepaid fees are non-refundable. We reserve the right to terminate services for breach of these Terms.
8. Limitation of Liability
To the fullest extent allowed by law, MMP is not liable for:
Indirect, incidental, or consequential damages
Platform outages, ad account suspensions, or lost revenue
Delays caused by third-party vendors or force majeure
Our total liability for any claim is limited to the amount paid by the client in the past 30 days.
9. Privacy
We collect and use personal data in accordance with our Privacy Policy, which forms part of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Kansas. Any disputes shall be resolved in the state or federal courts located in Kansas.
11. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes means you accept the revised Terms.
